I received a "No Change Letter"

I was sent a Notice of Deficiency letter. The 90 day
expiration to file with the tax court is on March 15, 2006.
On 2/17 I received from the IRS a "no change letter" dated
2/21/06 stating that they have accepted my challenge to the
$78,000 deficiency and that there is no change to my 2003
tax return. It also states if I received a NOD to disregard
it.

Is this a legitimate way to close the NOD? During my
research of this matter, I have read that if the NOD is not
rescinded with a form 8626 that the IRS can come back after
the 90 days is up and demand payment as stated in the NOD.

The "no change letter" states if I have filed with the court
to contact the IRS attorney or the appeals rep and get the
case closed by telling them I received a "no change letter".

Should I file a petition with the tax court or is the
information I read about getting "hearsay" statements from
the IRS over the top paranoia?

I would like to hear from someone that actually had a NOD
and also received the "no change letter" if you are out
there.

I know this has an old message. Was wondering if you ever got this resolved or did you end up filing rescind notice of deficiency?

Or does anyone ever have the same problem? I received notice of defiency and it is almost a week before 90 days expiration date. I received no change letter a week ago, was wondering if the case is closed or should i file the rescind notice of defiency? The problem is IRS wont respond in 5 days and I will need to make a decision.
