The problem is that with ESA there are a lot less boxes to tick,
especially for the mental health descriptors and also the threshold for
passing on mental health grounds alone has increased from 10 to 15.
Well, it always has been 15 but getting 10 points on mental health
grounds alone under Incapacity Benefit was treated as if the person had
got 15 points.

It never really was under IB, the examining Doctor usually gave a date
when the person should either be referred again or would be expected to
be fit for work.
Even if Niteawk passes the tribunal - and I expect him to, I've said it
before, then he may have to undergo a fresh Work Capability Assessment
at some point relatively soon. And so the whole process will begin again...
