Sorry, no. Adoption of your spouse's child(ren) is not an
eligible expense for the adoption credit. See Pub 17, page
248, for confirmation.

No credit to adopt your spouse's child as those expenses are
not considered "qualified adoption expense."

The IRS also offers certain tax credits and income
exclusions related to adoption expenses - see
http://www.irs.gov/taxtopics/tc607.html The fact that it's
your spouse's child does not take away from the ability to
qualify for applicable income exclusions and/or tax credits.

No you cannot. Qualified adoption expenses do not include
expenses for the adoption of your spouse's child. See the
instructions for form 8839 for details.

Per 2005 Instructions for Form 8839 Qualified Adoption
Expenses include among other things expenses paid "for the
doption of your spouse's child". See
http://www.irs.gov/pub/irs-pdf/i8839.pdf. the relevant
paragraph starts on bottom of page 1 and continues onto page
2 of the instructions. This does not agree w/ the Pub 17
instructions though.

couldn't before, unless that part of the tax law has
changed, still can't. I'd re-read the instructions for that.

Maren (know the situation)

You have misread the instructions. The information about
expenses of adopting your spouse's child is included in the
subparagraph titled "Qualified adoption expenses DO NOT
include expenses: "(emphasis added). It is easy to miss, as
the list spans two pages.
