Just wondering, as have a lot of research to do, for a situation my
girlfriend just found herself in where she is being asked to resign or be
sacked, whilst she is on the sick with ill health.

do NOT resign, if the company want to sack her for being on the sick they
*could* be breaking the law. I think she needs legal advise and should wait
to be sacked. She then has grounds possibly for unfair dimissal.
Certyainly claiming benefits would be easier if she were sacked, the only
downfall off being sacked is the possibility of having to explain to future
employees.

how long has she been with the company, how long on sick and is she under
the doctor ?

See post above. Entitled to what, after resigning on ill health.

17 years with company, not being sacked for being on the sick, but being
sacked for a previous gross misconduct, and she is on the sick for a month
and is going to be on the sick for a few more months, she is receiving
counseling/therapy and is not fit to work, the company have given her an
ultimatum, resign by the 23rd Dec, and we will pay you til end of jan, or
you will be sacked, whilst on the sick, and the company CAN and will do this
to her over this particular incident, as she has checked it with her union
rep.
