CA State Taxes for non-resident

Hello, I live and work in Florida. However, the company I
work for is located in California and CA state taxes are
withheld from my paycheck.

As I understand my wages should not be considered as sourced
in CA and so no CA taxes should be taken out.

What can I do to prevent taxes being withheld from my
paycheck or get a refund?

Is there anything on my paycheck or W-2 that indicates that
source of my wages is not in California?

Thank you.

If you don't work in California, I would bitch long and hard
to your HR people. Otherwise, file a CA NR return and claim
a full refund of any withholdings.

The error is your employer's, and you need to talk to its
payroll department. They should not be withholding
California tax from your salary unless you are performing
services in California.

You will need to file a California nonresident return to get
a refund of the taxes that were withheld in 2004. Your W-2
will probably show all of your wages as California earnings.
You should report zero California earnings (unless you did
perform some services in California) and include a statement
that you are a Florida resident and performed all of your
services in Florida.
