Capital loss carry forward question

I have not filed US tax return since 2002 because I no longer worked in
US. I have a sizable capital loss prior to 2002. Since only $3000
capital loss can be used for each year in tax return,
I still have this capital loss carry forward.

My question is: Can I file 03, 04 and 05 taxes returns (no US income)
and apply the carry-forward capital loss and get a refund check?

You would only get a refund if you had paid in, in the form of extimated
taxes or withholding from US wages. Certain other refundable credits are
available, but it appears that none of them fit your situation.

Are you planning on having US based income in the future?
