EIC & Single Mom

Mom rents two rooms in a house for herself & Son.
Father has home with new girlfriend.
Son is Mother 4 days Dad 3. No legal paperwork.
In past 6 years Dad claimed head of household, dependent,
child care & child tax credit. Mom only claimed EIC. This
was started by a tax chain and since they filled out the
forms the same way. Never a problem besides Mom getting
cheated. Mom asked me to help with her's this year.

The new rules look more restrictive.
Will this still work?

Dad can't claim HOH - and he never could from what you
posted. Dad may be able to claim the dependency deduction
with a 8332 signed by the mom. Dad can't claim the child
care, nor the child tax credit.

Looks like it's payback time for mom.

Child tax credit goes with dependency. If she signs the 8332
he gets both.

Mom accepts that the father claims dependant etc., he does
pay most cash needs for son. My question was; can she still
take the earned income credit for the son on her return as
in the past?

Pay careful attention. What Dad was doing in the past was
illegal then, and if he continues it it's illegal now.
Since the child was physically with Mom more than half the
year, only Mom can possibly qualify for HofH, EIC, and Child
Care Credit with respect to this child. Mom can, if she
chooses, give the personal exemption and child tax credit to
Dad.
