I am moving to Spain, can I get incapacity benefit there?
In a short word, "yes"!

You have to claim via the overseas branch of the DWP, which is based in
Newcastle.

You will still be subject to the same rules, eg no work without telling the DWP
and a medical every so often but I've yet to hear of anyone living abroad being
called for a medical other than getting a report from their GP - the DWP have
no examining centres in Spain as far as I'm aware!

If they did call you for a medical, I'd like to see the look on their
face when you submit your travelling expenses ;)

hehe!

I wonder what happens with people who live on the islands of Scotland when they
have to attend a medical?! It's not exactly a car drive away to the nearest
Social Security medical centre!

I know from my time as a visiting officer at the old DSS that the visiting
staff at one of the Scottish Highlands offices used to regularly travel by
aircraft to do their visits! On the other hand I was stuck on the number 18 bus
in London travelling around north west London, not quite as scenic...

Is this the same for all EU countries, for example Malta?

I don't know, sorry. There is a leaflet which is available from all local
benefit offices and I'd guess the leaflet is probably also on the dwp.gov.uk
website.

Why should the DWP be responsible for travelling expenses - its not their
fault you are living in Spain.
