Well I finally got a letter from the tribunal service giving me a date for a
hearing next month, it has taken 12 months to get this far so not bad at
all. That is in relation to stopping my component rate for failing to attend
WRAG, which I was not informed about. Never mind eh!

Meanwhile I had been asked to attend yet another ATOS sham medical in Sept
2010 which I naturally failed as is the norm. So I appealed against that
also.

I have just received news from the BDC stating that initial decision has
been revised in my favour. Common sense prevailed so I am looking forward to
receiving a nice few quid off them on my next pay day.

One down and one to go, I will let you know how it goes. ;)

It is with great pleasure that I must inform you all, (although this
forum now appears dead) my appeal was accepted. Well I say my appeal,
it has my name on it, thats about all.

It succeeded but not for any of the reasons I was expecting. It
appears that a lot of incriminating documents went missing from my
file so I am surprised it went in my favour.

The reasoning is as follows,"There was not sufficient evidence to show
that my medical condition was taken into account". "An appropiate
course of action was not planned".

IOW it is not enough to send a letter demanding someone with health
issues such as ze Niteawk has, to attend WRAG without some preparation
to accomodate ones medical issues. Remember that one folks, the Shaw
Trust cannot simply write to you demanding that you attend WRAG, they
also have to make some preparation for you to get there, once there
they have to be careful how they treat you etc. If you need a case
number to back this up, I have one here. ;)

It has taken over a year but I got there in the end even if it still
does not make any real sense. It just goes to show you have to fight
hard for your rights against corrupt officials at the DWP, Atos and
Shaw Trust quango's who act on their behalf and think they can do what
they like in the name of the government.

Anyway this is ze Niteawk signing off until the next tribunal. Watch
out for the bogey man, he is coming to get you in the guise of the
DWP.

I'm afraid the dwindling number of enquiries here is a symptom of the
slow death of Usenet.

It was a good result in the end, the tribunal was very scathing
towards Shaw Trust. If you are ill and can't attend a Pathways to Work
interview on health grounds, they should accept that as "good cause"
but being the fckin morons they are, they had to act the like idiots.
IOW ST cannot demand that you attend interviews if you say you are
ill, which is the reason why you have a friggin doctors cert in the
first place. They have to do a lot more than sending out BS
threatening letters telling you to attend, like make arrangements to
see you if you can't see them, arrange transport, send someone to
accompany you etc.

Good isn't it, ST bastards well shot themselves in the foot or what.

Not really, it'd be better if they had a clear grasp of what they're
trying to do and how best to do it.

From what I have seen of the system Shaw Trust has very little to do
insofar as procedure is concerned. I am sure they must know by now
that the job (if you could call it that) involves a little bit more
than just sitting on their arses and posting threatening letters. If
they expect claimants to understand the rules, the least they can do
is read the rule book themselves. Either they are so lazy they can't
even be bothered to check how the process works or they are
deliberately abusing the process to cause problems for people, I think
the latter.
