USA medical-paid by insurance, tax deductible

My son passed in december, the insurance company paid for the medical bills, but that was money I was suppose to receive. Can I claim those bills on this years taxes, since in one way I did pay for it?

Can you clarify if this was life insurance or medical insurance and also who was the policy holder?

it is auto insurance from our policy and the drivers policy. Our son was a passenger in the car.

would I need to know how much of it was the actual casualty policy?

Per tax rules your medical deduction is for what you paid - out of your pocket- for the medical premiums AND any medical bills you had to pay -and did pay- that were not covered and were paid out of your pocket. So what the insurance paid is NOT yours to deduct. Sorry and sorry for your loss.
