USA Non resident alien withholding tax on short-term capital gain tax

I am a resident of Taiwan and had invested in US mutual funds. Does anyone know whether or not a Mutual fund should withhold taxes on short-term capital gain distribution?

In Publication 515, it mentions "The exemption from withholding on certain interest-related dividends and short-term capital gain dividends paid by a mutual fund or other regulated investment company was scheduled to expire at the end of 2011. These provisions have been extended through 2013."

Any comments on this are appreciated.

My understanding is that there is no US- Taiwan tax treaty. So any payment to you from US will have a withholding tax.

If you are a non-resident alien you are not subject to US tax on capital gains, so could file a US income tax return and claim a refund.
