Pre BK question....

There is a chance that i might have to file bk7 on about 30k of CC debt. I
own a business that im thinking about turning into a LLC in effort to
protect it. If I do theLLC will this protect it. Also thinking about
selling business and the paying the bastards off and being done with all my
debt. But the main thing is i have protect the business until i sell it
before they get there hands on it.... any thoughts ideals??? thanks...

Can you actually help any of these people, or are you just trying to spam up
some mortgage business?

They are listed with the Chamber of Commerce of Southern New Jersey. They
may even have a good deal to offer, but they don't have a very professional
way of going about advertising.

Dudes, if you are going to post here offering to help, include your business
name. Otherwise, you are lowering yourself to the same level as porn
spammers and the like.

My apologies but I am not a spammer I am just putting my information
out there I wasn't going to continuously bother these people. Yes I do
work for Fidelity Borrowing, and I can be reached at the numbers that
were given. I do have some great programs that can help Chris and alot
of other people in this type of situation out.

When you post a name and number, you 1) look like a spammer and 2) will not
get many calls. If you want to advertise here, you should post full contact
information, including company name. That lets people know you are
legitimate, and you will likely get more calls. I would *never* call someone
who just posted a name and a number. A website link helps a lot also, and
increases the chances that you are legitimate and will increase your sucess
rate.

I am, at this time, looking to refinance my 2nd mortgage and/or turn it into
a line of credit. If you were in my area (because I won't do business with
people that aren't local, sorry), and if you had posted name, company
affiliation, and phone number I might have called you. But an anonymous name
and number - you will never hear from me.

no one has given me any answer or ideal on this little problem..... other
than to slam or bitch at the guy offering to probably loan me money at some
outragous interest rate to which i dont need nor want....so im still open to
help/ideals here.............any out there... surely im not alone here...

I don't believe your questions are unanswerable with the facts you've
presented.

None of us know how much time you need to shelter your business assets, what
the value is, what your other personal assets are, in what state you reside,
who your creditors are, etc., etc.

That you have stated it's a "little" problem seems to confirm you really are
in way over your head. Spend the money and retain local counsel. Your
problems are much too complicated for this forum.

Do not do this without speaking with an bankruptcy attorney first.

Pre-bankruptcy planning is essential. Doing the sort of things you suggest
without knowing what you're doing can create a huge mess for you. For
example, the transfer to the LLC may be set aside as either a preference or
a fraudulent conveyance if it isn't structured properly.
