I just wanted to tell my IRS horror story while I still can.



Late last year, my paycheck started getting garnished by the IRS. I work
for UPS in Las Vegas, Nevada, so a received a letter from HR stating that
they have an order to start garnishing my pay and if I wanted more
information to call the number in the letter. The number was to the IRS.



I call the IRS and try to find out why I was being garnished. I was told
that it was because I didn't file a tax return in 1997. Well there was
nothing to file because I did not work, I was unemployed living in another
city with my mother. Anyway, I explain this to the person I was speaking to
and she said it doesn't matter if I worked or not, I must file a return
every year. I asked her just how much was suppose to owe and she wouldn't
give me an amount but said that they filed a return for me for 1997 at what
my last tax return wages showed which was $14,000. This is not a lot of
money. I told the woman that on my last return I got a refund because I
didn't make enough money to pay any tax. I was told that they always set
the tax amount at the highest level when they file a return. So how is it
that I can be taxed on money that was never earned to begin with? What the
hell is that? The woman told me that there was nothing she could do about
it and that she could not tell me how much I was going to be garnished. As
of this date, they have garnished my pay a little over $9,000 with no sign
of ceasing. How do you get $9,000 in taxes from $14,000 in wages? Wages,
again, that never happened?



When I first got the letter about the IRS garnishing me, I did not call them
at first. I'll admit it, I was afraid. I wondered if I messed up on
something that I couldn't remember. But suddenly loosing 25% of my pay
every week can take its toll. I started falling behind on bills, and I was
now playing catch-up with everything. The power was shut off once. So I
started writing checks to keep utilities going with money I did not have-I
would write a check to Nevada Power knowing full well it would bounce the
first time but that gave me a week so the next time they put it through I
would have been paid and the check would clear.though sometimes this did not
work, as I did this with a lot of bills.



Now I was in danger of getting kicked out of my apartment I have lived in
for the past 6 years because I simply did not have the money to pay. I
called the IRS and tried to get them to stop the garnishment but they
refused. They said my situation wasn't a dire enough case to stop the
garnishment. I managed to get the money to pay the rent by going to one of
the payday loan companies, something I do not recommend to anyone but I had
no choice. Now I had the double problem of the garnishment and an automatic
withdrawal from my bank account to cover the payday loan.



I'll just end it by saying that I dodged the bullet for another month, but
it appears that I have lost the fight. I will be evicted from my apartment
where I sit writing this post this evening. I owe $820 by Monday or I am
evicted, and will be living in my old GMC Jimmy. I did a little research,
and I learned that the IRS can garnish your pay for 10 years. Well at this
point it really doesn't matter anymore. You know I've actually entertained
the idea of suicide; I'm ashamed to say it. But I'm a stubborn guy, I'll be
homeless in a few days, but if I don't get fired by UPS for not having an
address and I get through the summer heat in my truck, I'm sure I can
recover. But I will still have to deal with the IRS. I just wanted get
that off my chest.

Are you.....planning on not having internet service in the future?


But I will still have to deal with the IRS. I just wanted get
that off my chest.

Go see a tax pro. If the garnishment is not valid, it can be removed and
you can get a refund of the taxes taken.

If however, it IS a valid garnishment, then a tax pro should be able to
reduce the amount from each check so you can make ends meet.

If what you say is true, then you're an idiot for not going to see a
lawyer or accountant to get this straightened out.

Stop sitting around feeling sorry for yourself and find a lawyer or
accountant to help you put an end to the garnishment and get your
money back.

Sec. 6331. Levy and distraint

-STATUTE-
(b) Seizure and sale of property
The term ''levy'' as used in this title includes the power of
distraint and seizure by any means. Except as otherwise provided
in subsection (e), a levy shall extend only to property possessed
and obligations existing at the time thereof. In any case in which
the Secretary may levy upon property or rights to property, he may
seize and sell such property or rights to property (whether real or
personal, tangible or intangible).

Very telling set of words. If the Secretary may levy, the
Secretary may seize.

In the interpretation of statutes levying taxes it is
the established rule not to extend their provisions, by
implication, beyond the clear import of the language used, or
to enlarge their operations so as to embrace matters not
specifically pointed out. In case of doubt they are construed
most strongly against the government, and in favor of the
citizen. United States v. Wigglesworth, 2 Story, 369, Fed.
Cas. No. 16,690; American Net & Twine Co. v. Worthington, 141
U.S. 468, 474 , 12 S. Sup. Ct. 55; Benziger v. United States,
192 U.S. 38, 55 , 24 S. Sup. Ct. 189.
GOULD v. GOULD , 245 U.S. 151 (1917)

What is not said, is that if the Secretary can not levy, the
Secretary can not seize.

Sec. 6331. Levy and distraint
(a) Authority of Secretary
If any person liable to pay any tax neglects or refuses to pay
the same within 10 days after notice and demand, it shall be lawful
for the Secretary to collect such tax (and such further sum as
shall be sufficient to cover the expenses of the levy) by levy upon
all property and rights to property (except such property as is
exempt under section 6334) belonging to such person or on which
there is a lien provided in this chapter for the payment of such
tax. Levy may be made upon the accrued salary or wages of any
officer, employee, or elected official, of the United States, the
District of Columbia, or any agency or instrumentality of the
United States or the District of Columbia, by serving a notice of
levy on the employer (as defined in section 3401(d)) of such
officer, employee, or elected official.

Please note that “levy may be made upon the accrued salary or
wages of any employee OF the United States. A quick look at the
definition of employer in section 3401 will show that the employer is
defined in terms of the employee.

CHAPTER 24 - COLLECTION OF INCOME TAX AT SOURCE ON WAGES

Sec. 3401. Definitions
(d) Employer
For purposes of this chapter, the term ''employer'' means the
person for whom an individual performs or performed any service, of
whatever nature, as the employee of such person, except that -

Which means in order to understand who the employer is, one must
look at the meaning of “employee”.

Sec. 3401. Definitions
(c) Employee
For purposes of this chapter, the term ''employee'' includes an
officer, employee, or elected official of the United States, a
State, or any political subdivision thereof, or the District of
Columbia, or any agency or instrumentality of any one or more of
the foregoing. The term ''employee'' also includes an officer of a
corporation.

Thus, even if I was a “person liable” as mentioned in section
6331(a), I am not employed BY the United States, I am not an employee
OF the United States or any other governmental body. Those are the
only people the law clearly states may be levied or have property
seized under administrative due process. The Constitution of the
United States says:

Amendment VII
In suits at common law, where the value in controversy shall exceed
twenty dollars, the right of trial by jury shall be preserved, and no
fact tried by a jury, shall be otherwise reexamined in any court of
the United States, than according to the rules of the common law.

Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a
speedy and public trial, by an impartial jury of the state and
district wherein the crime shall have been committed, which district
shall have been previously ascertained by law, and to be informed of
the nature and cause of the accusation; to be confronted with the
witnesses against him; to have

compulsory process for obtaining witnesses in his favor, and to have
the assistance of counsel for his defense.

Has the U.S. Constitution been amended such that due process
no longer includes jury trials such as noticed in the Sixth and
Seventh Amendments? If so, please indicate which Amendment repealed
the provisions of the Sixth and Seventh Amendments.

The IRS doesn't have to answer your questions about the tax law. They are
not not the ones who write these laws. You should ask these questions to
members of Congress. Have them explain to you what their thought processes
were when they passed them. The job the IRS has is to enforce the tax laws
as written by Congress. Stop blaming IRS and seek answers from Congress.

Santorum (Pennsylvania), in response to the questions of "Operation
Honest Inquiry." For those who don’t know, Senator Santorum claims to
be a pro-freedom, conservative Republican. His actions suggest
otherwise. The text of his letter is in blue, and I have added my own
