Non taxable sick pay and 403b

I'm on long term disability. a portion was deposited in my 403 b and listed as non taxable sick pay box 12 letter j on my W2 from 2006 until 4/2010. as of this april the employer had me move to an annuity account of my choosing. money will still be reported on W2 in Box 12 J. Explanation by employer given was " .. as of April 2010 we are paying premiums on your behalf therefore benefit cannot go to 403 b which is a pre-tax account"

I'm wondering if it's possible/probable the employer made an error from the start in 2006 allowing this "non taxable sick pay' benefit to go to a 403Bin the first place? This change in tax status after 4 years doesn't make sense to me?
