1244 small business loss

If someone establishes a company that buys land and develops it into sellable lots, but it then goes bankrupt, can they claim the $50,000 ordinary loss on their stock? The tax rules I was looking at mentioned that 90% of the real property had to be used in the business. Would this be considered used in the business if the property was never sold?
