USA First Time Abatement

We did not file for an extension to file a client's return and now may be subject to a substantial late filing penalty - $11,000.

Client never filed a "late" return before, always within the extended due date deadline. Client historically pays their taxes with the return, so has experienced late payment penalties.

What is your opinion regarding the possibility of applying for a "First Time Abatement" of such a large potential late filing penalty?

The return will be filed by 7/31 and was due on 4/15.

Any help would be greatly appreciated.

Typically, IRS penalties will be upheld unless you can show reasonable cause as to why the incident that caused the penalty occurred. You're going to have to write a very convincing letter and explain the circumstances that led to not filing the extension. Hopefully it's more than "we forgot."
