USA Illegal to email returns?

I just saw an ad in Accounting Today about it being illegal to email tax returns in some states. Anyone have any information on this? I have done some research but can't seem to find much that clearly states whether it is true or not.

Any input would be much appreciated!

Per Circular 230, as I understand it, email is fine if the data in encrypted or others protected. So sending an unprotected pdf file via email would not be correct.

As a preparer, you are also not supposed to recieve such unprotected files.

I tell clients all the time if they are sending unprotected information to use the more secure upload function on my website.

I am not aware of any states being more restrictive.
