Roth conversion processed after 12/31

we received advice from our accountant in 2008 that we had untiil 4/15/2009 to make a conversion from traditonal ira to roth ira. We asked our brokers to do this and told them it was for tax year 2008 and they processed the request without question.


In 2010 we recevied a conversion form for the money to show as distribution for 2009. The taxes were filed and paid for the 100K of conversion on our 2008 tax reutrn.

Now the IRS is coming to us to pay the taxes on it again for 2009 although we already paid in 2008.

We now know that the conversion deadline was 12/31/2008 and we were not aware or informed of that by tax accountant or brokers. What can we do to get the IRS to allow us to not have to pay the taxes again?
