USA FSA for nonresident alien

Hi everyone,

I'm glad to find this place to discuss! Anyone has insights about can nonresident alien take advantage of tax benefits of FSA? i found some employer said no, but some said yes. I am confused, shouldn't this be decided by IRS and be applied consistently?
