Builder Filed Bankruptcy - How to claim court award discharged?

Long story short.... Went through a 5 year battle with a builder on a new house.

Went to Arbitration (Court Legally)...
Won a $75k award against the builder
He went into Bankruptcy immediately.
I was only Creditor
$0 of Capitalization in Corporation
Fought the bankruptcy for 3 more years (Piercing Corporate Veil)
Collected about $6.5k Bankruptcy court retrieved from them personally
Bankruptcy discharged..

So I owned a Debt ($75k - $6.5k = $68.5) that is not collectable.
I also spent an additional $40k in legal Fees trying to fight this post Builder Bankruptcy..

1) Can I claim the Debt discharged of $68.5 in 2010 against income? How?
2) Would I claim the other Legal Fees of $40k when the house is sold?

I see these Legally as two different elements. One is Debt and the other is Expenses?

It seems Like if I am holding an official Court declared award that is uncollectable that it should offset something?

No One wants to give a high level opinion if this is possible?

My CPA was clueless on it? So should I talk to IRS or what?
