Yup. they are.
See instructions -page 4) for form 1065 (includes K1)
That says they get fined at least $100 for not sending it to you.
Then
if you don't get it
file a form 8082 to let IRS know they didn't send it and then on your return you'll have to estimate that missing amount. (amend when you finally get a k1).
